When an agency wants to report a justifiable homicide, they will create a NIBRS incident that looks like any other NIBRS incident, with the following details:


  • Offense 09C
  • Victim segment contains details of the person killed by the officer or citizen
  • Offender contains details of the citizen/officer who killed the other person
  • There will be no arrest information because no one is arrested (it's justifiable).
  • Because there is no arrest information, there is no arrest offense, and therefore no statute requirement

When we report NIBRS data we have different ways of counting, such as the number of incidents, number of offenses, number of victims, etc.  For each of these, you can filter by offense, so you can get a count of victims of offense 09C.  


One of our measures for counting is "Number of Crimes".  For this measure, we have implemented the FBI counting rules.  As a general rule, this means for crimes against persons (such as murder, agg assault, etc) we count the number of victims.  However, for 09C, our Number of Crimes is always 0.  


By definition, no crime was committed for a NIBRS offense of 09C.
